Ai sensi dell’art. 13 del D. Lgs. 196/2003 (di seguito “Codice Privacy”) e dell’art. 13 del Regolamento UE n. 2016/679 (di seguito “GDPR 2016/679”), recante disposizioni a tutela delle persone e di altri soggetti rispetto al trattamento dei dati personali, desideriamo informarLa che i dati personali da Lei forniti formeranno oggetto di trattamento nel rispetto della normativa sopra richiamata e degli obblighi di riservatezza cui è tenuta.

DATI DI NAVIGAZIONE

I sistemi informatici e le procedure software preposte al funzionamento di questo sito web acquisiscono, nel corso del loro normale esercizio, alcuni dati personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet.

I dati vengono inseriti e inviati spontaneamente dall’utente che desideri essere contattato dal proprietario del sito, nonché Titolare del trattamento, per ricevere informazioni collegate a specifiche richieste. I dati raccolti saranno utilizzati esclusivamente per rispondere alle richieste inoltrate e saranno trattati ulteriormente solo qualora si instaurasse un rapporto commerciale tra l’utente e il Titolare.
• Registrazione all’area riservata (se presente e attiva): Le informazioni personali inserite all’interno del form di registrazione all’area riservata sono necessarie alla creazione del profilo personale per effettuare l’accesso ad essa. I dati vengono inseriti e inviati spontaneamente dall’utente che desideri accedere a suddetta area. Tutti i dati inviati e raccolti attraverso l’area riservata saranno utilizzati per rispondere alle richieste specifiche dell’utente registrato (es. per il recupero delle credenziali di accesso, informazioni sull’attività del Titolare, gestione del rapporto commerciale, …), nonché per facilitare successivi rapporti commerciali con l’interessato. La registrazione è eventualmente necessaria per l’utilizzo delle funzioni relative all’E-Commerce presenti sul sito.
• Portale E-Commerce (se presente e attivo): all’interno del sito potrebbe essere disponibile un’area dedicata al commercio elettronico, all’interno della quale l’utente può visionare ed eventualmente acquistare prodotti e servizi forniti dal Titolare del trattamento. I dati saranno trattati dal Titolare per rispondere alle specifiche richieste degli utenti e per concludere transazioni commerciali con essi. Il Titolare del trattamento adotta tutte le misure di sicurezza necessarie per proteggere i dati dell’utente comunicati al momento della transazione, in particolare per quelli collegati agli strumenti di pagamento utilizzati. Successivamente i dati dell’utente saranno ulteriormente trattati e conservati secondo le modalità descritte per la clientela ordinaria nella specifica informativa, disponibile presso il Titolare del trattamento (esclusivamente per quanto concerne il trattamento di dati personali).
• Newsletter e attività di marketing attraverso il trattamento di dati comunicati tramite il sito (se presente e attivo): attraverso il servizio di newsletter o altri canali eventualmente utilizzati dal Titolare (canali social, servizi di messaggistica, etc.), esso svolge attività di promozione dell’attività aziendale presso gli utenti e la clientela mediante l’invio di email o altre comunicazioni telematiche contenenti informazioni commerciali e di marketing. Il trattamento sarà svolto nel rispetto e nei limiti etici e della normativa, senza arrecare danno a diritti e libertà degli interessati. La comunicazione dei dati per le finalità di erogazione del servizio di newsletter o di altre attività di marketing diretto e indiretto è sottoposta al previo consenso dell’interessato qualora l’indirizzo mail o altro recapito sia raccolto attraverso il sito ove, per poter inoltrare i dati al sistema, è necessario spuntare l’opzione con cui si presta consenso espresso per tale finalità. COMUNICAZIONE DEI DATI A TERZI

L’ambito di comunicazione dei dati è limitato esclusivamente a soggetti qualificati come titolari autonomi del trattamento quali forze di polizia, autorità pubbliche, organismi di vigilanza ed altri soggetti pubblici o privati che hanno facoltà di trattare i tuoi dati .

Essi pertanto potranno essere comunicati a terze parti, preventivamente individuate e nominate, ove necessario, responsabili del trattamento ai sensi dell’art. 28 RGPD appartenenti alle seguenti categorie:

• società che forniscono servizi per la gestione del sistema informativo e del sito web (piattaforme E-commerce e di pagamento, consulenti nello sviluppo del sito web, etc.);
• studi o società che erogano servizi nell’ambito di rapporti di assistenza e consulenza (in ambito informatico, contabile/amministrativo, etc.);

• società ed enti che svolgono servizi tecnici o di consulenza riguardanti le attività di ricerca di mercato, di marketing e promozione della nostra attività e dei nostri prodotti;
• enti, amministrazioni ed autorità pubbliche, per l’adempimento degli obblighi di legge connessi al rapporto commerciale, qualora si riscontrassero evidenze di crimini o attacchi informatici contro il nostro sistema o gli altri utenti visitatori del sito o nell’ambito della gestione del contenzioso con l’interessato.

FACOLTATIVITÀ DEL CONFERIMENTO

Il conferimento dei dati è obbligatorio qualora sia necessario per accedere e visualizzare correttamente il sito web, a gestire le richieste e la comunicazione, ad erogare il servizio e ad adempiere e concludere il contratto con l’interessato. Il mancato conferimento di tali dati renderà impossibile visualizzare il sito web, gestire le richieste o la comunicazione, concludere il contratto o eseguire la prestazione concordata.

TRASMISSIONE DEI DATI

La gestione e la conservazione dei dati personali avverrà su server del Titolare e/o di società terze incaricate e debitamente nominate quali Responsabili del trattamento, ubicati all’interno dell’Unione Europea, ovvero in conformità di quanto previsto dagli artt. 45 e seg., GDPR. Attualmente i server sono situati nell’Unione Europea. I dati non saranno oggetto di trasferimento al di fuori dell’Unione Europea. Resta in ogni caso inteso che, qualora si rendesse necessario trasferire l’ubicazione dei server, in Italia e/o Unione Europea e/o Paesi extra-UE, tale spostamento avverrà sempre in ossequio agli artt. 45 e seg., GDPR. In tal caso, comunque, il Titolare assicura sin d’ora che il trasferimento dei dati extra-UE avverrà in conformità alle disposizioni di legge applicabili stipulando, se necessario, accordi che garantiscano un livello di protezione adeguato e/o adottando le clausole contrattuali standard previste dalla Commissione Europea.

OPTIONALITY OF CONFERMENT
